It's like if Scotland had voted to be independent, and then it's leaders just went with staying in the UK with more local powers, the people want something, the leaders promised it, and all you did was give us a tiny sliver of what we actually wanted.

No it shows you don't want a 1 month bans, or you would've just rolled with it. since you don't need unanimous opinion to get that 1 month, you don't compromise on something you have a majority for already.

You clearly did, you initially said one month and keep trying to get WP to go down from your initial idea to Turks, so you clearly don't support you're own idea. and are far down on the punishment.

Don't try to go I "replaced" a socialist with a socialist, this isn't a Conservative, versus socialist issue that defense isn't going to fly here

also there are many different types of Socialists and they don't get along.

by law the President makes appointments, so it should fall onto her to make an appointment not you; she is also an elected official therefore the will of the people will have a say in her appointment and not some justice who would make his picks based on who supports his position because he doesn't have to worry about the people's wrath.

We should have the right to approve of the temp judge (for approval of the admin action) not the CJ  to accurately reflect our views  and if the court denies us this right then we the posters on this thread call for the administrations to ignore the court and do the right thing here

Acknowledging The powers and responsibilities of the moderators and administrators of the region to maintain the peace and order,

Recognizing The authority of such leaders, as well as the rights of the individual users in the forums,

Realizing That under current law, moderators and administrators can take any action that they wish, without any sort of reparation for the actions that they take,

Congress Hereby Mandates The creation of a set of rules and regulations that govern what actions are deemed illegal and punishable, the strength of the actions, and the actions that may be taken upon such illegal activities.

Under the creation of this bill, only certain punishments may be taken by the Moderator/Administrator team upon an individual at the immediate moment of the event. Furthermore, this bill shall give power to the judiciary branch to review the actions of both the M/A team, as well as the individual, and decide upon more serious and/or permanent actions. This bill shall also outline which actions may be taken depending on the offense, and separates out of character and in character actions and responses.

Section I No member of the Administraration, Moderator, or Judiciary team shall commit an out of character punishment upon a user who has committed an in character offense, and vice versa, without the review of both the RP committee and the Judiciary branch.

----------Article I: A player who has committed an out of character offense, such as flaming, shall not have their nation or their character punished for such an action. The players actions, however, shall be further reviewed by the appropriate members, to make sure that no such traces of illegal actions are present.

----------Article II: The members of the RP committee shall review the players In Character actions, to determine if such actions are fueled by out of character emotions. For example, a player who constantly insults another's nation in character, may be warned for baiting because of the intention behind it.

Section II The Judiciary Branch is responsible for reviewing as well as ruling upon actions both In Character and Out Of Character, and shall make the appropriate punishment, or lack thereof, based upon the actions. More serious cases shall require all three of the judges, and less serious cases may require only one or two.

----------Article I: Any OOC action that is continuous is to be characterized as a serious case, and will require the review and ruling of all three judges. Individual actions brought up by the player, however, are to be dealt with by the M/A team, and may consult with the Judiciary for further course of action.

----------Article II: In Character actions and cases are the only cases that shall be categorized as serious or mild. Cases involving the Attorney General against the user, regardless of the action, are always classified as serious, and as such, require all three judges. Cases brought up by the player’s nation  against other players’ nations, however, are always mild, and shall be reviewed by one judge.

Section III The following list contains all current illegal activities, both In Character and Out Of Character. Punishments for such items are determined as needed, based on the situation where such items occurred. It should be noted that IC punishments shall not be automatically committed to Out of Character actions, and Vice Versa. This list may be amended as needed to include more.

----------Article I:
  • Flaming/OOC: Flaming is where a person intentionally insults or uses obnoxious swear words, either repeatedly or on its own (depending upon the word), with the explicit purpose of upsetting or offending a person or group of persons. The obnoxious and continuous use of swear words, whether or not with intent, is categorized as mild Flaming.
  • Baiting/OOC/IC: Baiting is the action of intentionally upsetting a person, and in turn causing him to lash out in an offensive way. Such actions may be both IC or OOC, depending upon the context of the action. Such actions may include the annoyance of another player, the repeated teasing and name calling, or the subtle insulting of a person with the intent of upsetting him. Such actions should be differentiated from snark, sass, or sarcasm.
  • Trolling/OOC/IC: Trolling is similar to baiting, but has the intent of riling up or upsetting a larger group of people, with no other intention. It is commonly associated with playing dumb, ie acting like one does not know their action’s affect, or simply by taking an intentionally unintelligent stance upon a subject. It can include insults and offensive actions. Furthermore, the action can be directed against one player, with the intention of also upsetting people with similarities to the player.
  • Blackmail/OOC: Blackmailing is the intention of threatening a player with the release of information, or the release of actions against the player, if he/she does not do as the blackmailer requests. This is not to be confused with the threatening of legal action against the player if he continues, which is considered an order to Cease and Desist.
  • Harassment/OOC/IC: Harassment is not necessarily a single action taken, but rather the continuing of offensive or illegal activities against a single, or multiple, persons. It includes the singling out of a person for no reason. It can also be the action of bullying a person, through any means. This is also the continuous annoyance of a player, and should not be confused with Trolling or Baiting, as it may or may not use offensive language or actions.
  • Abuse of Power/OOC/IC: Abuse of Power, or AOP, is where a person in a position of authority and/or responsibility uses his powers inappropriately for either personal or irresponsible intentions. The singling out of a single person, for personal reasons, is considered an abuse, as well as for means otherwise not prescribed. This action is also considered if a person overpunishes, or rather punishes for no reason. This should not be confused with continuous action against a single person for real reasons, which will be the perpetrator’s fault.
  • Death Threats/OOC: Death Threats are considered the worst offense a person can take upon another, and is the only offense that shall warrant the immediate silencing of the person (removal of the ability to post, send messages, and other items). The person’s continuation on the forum shall be decided by the Judiciary and M/A team, with input from the region.
  • Breaking of Laws/OOC/IC: Breaking of the laws both In Character and Out of Character is an offense, which is punishable by the court, and only by the court. This is the only mainly IC illegal action.

----------Article II: Punishments shall be taken by the acting M/A team on a case by case basis, but shall contain the following escalation: Warning, Warning, Post Ban, Forum Ban, Restriction, Delete and Restriction, Post Moderation, and Delete on Sight. Bans and Restrictions shall never be permanent, and shall be considered temporary actions against a person, which times shall be made to coincide with the Judiciary and M/A team. Post Moderation shall be put in effect upon a person so that they may not post offensive things until the Judiciary Team has convened, and conducted a ruling upon the person, as well as his actions.

--------------------Note I: Such punishments are considered immediate punishments, given out at the immediate sight of the actions. Forum Bans and above must be decided and ruled upon by the Judiciary team, which will take consideration and advice from the Administrative team.

--------------------Note II: The escalation of punishment is considered a guideline, and depending on the case in hand, may be completely ignored. Users, however, are guaranteed chances to correct themselves, though if such apologies and actions are frivolous and without meaning, shall not be continued.

--------------------Note III: The Escalation of punishment guidelines are only applicable upon a set offense, such as Flaming. A person may receive multiple warnings (up to and including five) on other offenses before his case is brought to the Court and further actions decided upon by the M/A and Judiciary team. Furthermore, his history is to be taken into complete consideration, and his illegal actions recorded and/or deleted from the forums.

--------------------Note IV: All punishments and actions taken by the M/A team must be recorded for all members, as well as future members, of the M/A team. Furthermore, a clear list of people considered DOS must be recorded. All items must be recorded manually in this matter:

--------------------Note V: A member of the Judiciary and M/A team shall not act, rule, or review upon reports made against that member, nor shall they review, rule, or act upon the appeal made against their decision. They may, however, give their reasoning for the punishment or action taken.

Section IV A user may submit an appeal against the punishment dealt out by the M/A team. The appeal, however, may only be brought forward by the punished user, and not by a third party. Cases brought by persons against the M/A team, however, shall always be reviewed by court, unless the case is considered to be frivolous, and shall be considered Harassment.

----------Article II: If an appeal is successful, then the person who administrated the punishment shall not be punished. The report and history of the action taken shall be stricken in the forum, and shall not count against the user.

----------Article III: A user may submit another appeal, which shall be labeled a Final Appeal, and will be reviewed SOLELY by three members (usually judges) who were not involved in the situation. After this, no more appeals may be made.

----------Article IV: The residing President of the NCSA may pardon a member or members of their infractions. Multiple pardons shall be reviewed by the Judiciary team, which shall examine the cause of such pardons, and thereby determine it’s validity.
